In 1969 Harry Frankfurt published his hugely influential paper 'Alternate Possibilities and Moral Responsibility' in which he claimed to present a counterexample to the so-called 'Principle of Alternate Possibilities' ('a person is morally responsible for what he has done only if he could have done otherwise'). The success of Frankfurt-style cases as counterexamples to the Principle has been much debated since. I present an objection to these cases that, in questioning their conceptual cogency, undercuts many of those debates. Such cases (...) all require a counterfactual mechanism that could cause an agent to perform an action that he cannot avoid performing. I argue that, given our concept of what it is for someone to act, this requirement is inconsistent. Frankfurt-style alleged counterexamples are cases where an agent is morally responsible for an action he performs even though, the claim goes, he could not have avoided performing that action. However, it has recently been argued, e.g. by John Fischer, that a counterexample to the Principle could be a 'Fischer-style case', i.e. a case where the agent can either perform the action or do nothing else. I argue that, although Fischer-style cases do not share the conceptual flaw common to all Frankfurt-style cases, they also fail as counterexamples to the Principle. The paper finishes with a brief discussion of the significance of the Principle of Alternate Possibilities. (shrink)

Many philosophers endorse “exclusionism”, the view that no instance of relearning qualifies as a case of genuine remembering, and vice versa. Appealing to simulationist, distributed causalist, and trace minimalist theories of remembering, I develop three conditional arguments against exclusionism. First, if simulationism is right to hold that some cases of remembering involve reliance on post-event testimonial information, then remembering does not exclude relearning. Second, if distributed causalism is right to hold that memory traces are promiscuous, then remembering does not exclude (...) relearning. Finally, if trace minimalism is right to hold that vicarious experiences sometimes produce the minimal traces that ground remembering, then remembering does not exclude relearning. While advocates of these theories might incorporate additional conditions designed to accommodate exclusionism, the only reason they can appeal to in favor of doing so is intuition: neither the fundamental components of the theories nor the empirical results on which they are based provide a reason to endorse exclusionism. An investigation of exclusionism thus raises metaphilosophical questions, so far overlooked in philosophy of memory, about the appropriate role of intuition in theorizing about remembering. (shrink)

Reasons can play a variety of roles in a variety of contexts. For instance, reasons can motivate and guide us in our actions (and omissions), in the sense that we often act in the light of reasons. And reasons can be grounds for beliefs, desires and emotions and can be used to evaluate, and sometimes to justify, all these. In addition, reasons are used in explanations: both in explanations of human actions, beliefs, desires, emotions, etc., and in explanations of a (...) wide range of phenomena involving all sorts of animate and inanimate substances. This diversity has encouraged the thought that the term 'reason' is ambiguous or has different senses in different contexts. Moreover, this view often goes hand in hand with the claim that reasons of these different kinds belong to different ontological categories: to facts (or something similar) in the case of normative/justifying reasons, and to mental states in the case of motivating/explanatory reasons. In this paper I shall explore some of the main roles that reasons play and, on that basis, I shall offer a classification of kinds of reasons. As will become clear, my classification of reasons is at odds with much of the literature in several respects: first, because of my views about how we should understand the claim that reasons are classified into different kinds; second, because of the kinds into which I think reasons should be classified; and, finally, because of the consequences I think this view has for the ontology of reasons. This paper seeks a better understanding of the elements of practical reasoning: premises and conclusion. It argues that the premises of practical reasoning do not normally include statements such as ‘I want to ϕ’; that the reasoning in practical reasoning is the same as in theoretical reasoning and that what makes it practical is, first, that the point of the relevant reasoning is given by the goal that the reasoner seeks to realize by means of that reasoning and the subsequent (...) action; second, that the premises of such reasoning show the goodness of the action to be undertaken; third, that the conclusions of such reasoning may be actions or decisions, that can be accompanied by expressions of intention, either in action, or for the future; and that these are justified, and might be contradicted, in ways that are not only peculiar to them (i.e. in ways that diverge from those found in theoretical reasoning), but are distinctively practical, in that they involve reference to reasons for acting and to expressions of intention, respectively.1. Two conceptions of motivating reasons, i.e. the reasons for which we act, can be found in the literature: (1) the dominant 'psychological conception', which says that motivating reasons are an agent's believing something; and (2) the 'non-psychological' conception, the minority view, which says that they are what the agent believes, i.e. his beliefs. In this paper I outline a version of the minority view, and defend it against what have been thought to be insuperable difficulties - in particular, difficulties concerning (...) 'error cases' (cases where what the agent believes is false); and difficulties concerning the explanation of action. Concerning error cases, I argue that if we are motivated by something believed that is true, what motivates us to act is a motivating reason. By contrast, if we are motivated by something believed that is false, then what motivates us to act is merely an apparent motivating reason. Either way, what motivates us is, as the non-psychological conception says, what we believe and not our believing it. I offer an account of the relation between motivating reasons and the explanation of action, and argue that this account helps bring out two important points. One is that the fact that we often do, and indeed sometimes must, use explanations such as 'He did it because he believed that p' does not vindicate the psychological conception of motivating reasons. The other is that endorsing the non-psychological conception of motivating reasons does not commit one to a non-factive view of explanations of action. (shrink)

Se plantea el problema de la existencia de una campo científico -el geográfico - para el cual existen candidaturas e disciplinas determinadas como la Geografía Física, La Humana, la R egional y la Universal, etc. Se plantea la diferencia entre ciencias naturales y humanas, así como entre ciencias texonómicas y ciencias mereológicas, como marcos de análisis para las ciencias geográficas.

Baruch Spinoza famously said, “Whatsoever is, is in God, and without God, nothing can be, or be conceived”. This form of Pantheism is quite like eastern Pantheism, where in Hinduism they assert that “everything is Brahma”, or in Taoism, where Lao Tzu says, “Heaven and I were created together, and all things and I are one”. Although the western and eastern world shared their respective ideas of Pantheism, Native Americans also contributed to such discussion. However, comparative philosophy between western and (...) Native American philosophy has been far neglected, and the same neglect has been shown regarding Native American contribution to Pantheism. Many Indigenous religions believe that there is a Great Spirit that is manifested as a life force or energy that communicates and speaks through nature. In other words, some Native American tribes believe that nature, or in extension the universe, is part of a Great Spirit that communicates to individuals in a naturalistic way. Such a Great Spirit created the world and is in everything that the Great Spirit created. Moreover, there are other Indigenous beliefs that not only hold a Pantheistic view but hold a Panentheistic perspective where God is a being that is present in creation but transcends from it. Therefore, although Indigenous beliefs about Pantheism or Panentheism have been much neglected, there is much to say about it. With such input from Native American religious culture, this paper seeks to show and compare Spinoza’s Pantheism and that of Native Americans. In addition, I wish to investigate in what ways Native American philosophy contributes to the discussion of cosmology, nature, and Pantheism. In particular, how do some Native American tribes understand God in a Pantheistic sense where nature and cosmology are one. (shrink)

In this paper I propose a way of characterizing human agency in terms of the concept of a two‐way power. I outline this conception of agency, defend it against some objections, and briefly indicate how it relates to free agency and to moral praise‐ and blameworthiness.

In these pages, we will try to study figures like Cabet, Fourier or Saint - Simon, and we will do so in order to achieve better understanding concerning their own historical and their own intellectual context. Consequently and leaving our papers on Robert Owen behind, we plan to set special emphasis on the European Continent now. Résumé : Les domaines de la philosophie et de la théorie politique ont connu un certain nombre de changements au cours des quarante dernières années. L'un attire notre attention tout particulièrement ; le basculement d'un point de vue national, cristallisé par le contrat social rawlsien, vers un point de vue non-national. En effet, plusieurs penseurs abordent un ensemble de phénomènes considérés comme nouveaux, tels que les traités de libre commerce et l'économie globale, les entreprises et les institutions supra et transnationales, (...) l'immigration et les contrôles frontaliers etc. Ces changements sont intéressants puisqu'ils obéissent, principalement, à une évolution majeure du terrain politique et social que l'on appelle mondialisation. Les théoriciens travaillant dans le domaine de la justice globale semblent s'adresser à deux questions différentes mais reliées. La première concerne la justice globale : dans quelle mesure et pourquoi l'ordre mondial est-il juste ou injuste ? Qu'est-ce qu'un ordre global juste ? La deuxième est dans un sens corollaire à la première, et concerne la responsabilité : qui devrait être blâmé ou digne d'éloge pour l'ordre mondial ? Est-ce que les citoyens sont responsables de l'ordre mondial ? Qui devrait redresser ses éventuelles conséquences injustes ? Face à l'économie mondialisée et aux institutions politiques et économiques internationales et trans-nationales, cette interrogation devient légitime et nécessaire : suis-je responsable à l'égard des travailleurs des sweat shop lorsque j'achète des habits à Auchan ou bien à l'égard des caféiculteurs très mal payés lorsque je prends un capuccino dans un café Starbucks ? Est-ce que les citoyens sont responsables des traités de libre commerce que leurs gouvernements signent ? Ces questions sur la responsabilité des individus dans le contexte de la mondialisation seront l'enjeu de ce travail de recherche. Nous interrogerons plus exactement la responsabilité d'un agent lorsqu'il fait partie d'un chaîne causale complexe, lorsqu'il participe d'une injustice structurelle. Ainsi, il ne s'agit pas seulement d'une chaîne causale, mais de connexions qui sont l'issue d'un changement des modes de productions, de consommation et de la concurrence dans un marché mondialisé. Plus important encore, il ne s'agit pas simplement de la responsabilité individuelle mais plutôt de la responsabilité individuelle en tant que citoyen, et donc d'une responsabilité politique. Elle peut certes être individuelle, mais nous devons tenir compte du fait qu'elle doit être pensée en tant que responsabilité politique, et pas uniquement morale, puisque l'individu et ses actions sont déterminés par des communautés politiques dans lesquelles il participe, ou dans lesquelles il est représenté. Ainsi, la mondialisation nous invite à repenser la responsabilité individuelle pour pouvoir rendre compte des intuitions morales et politiques qui guident une bonne partie du champ de la justice globale. Pour cela, nous verrons dans un premier temps la manière dont les théories de la justice globale essaient de répondre à ce défit. Grâce à cela nous dégagerons l'hypothèse qui nous guidera, l'idée que dans la mondialisation, un agent peut être responsable, avec d'autres, des raisons pour lesquelles il n'est pas considéré comme responsable. C'est-à-dire qu'il sera méta-responsable. Dans un second temps, nous essaierons de déterminer un model de responsabilité individuelle, et de comprendre comment la responsabilité est attribuée. Ensuite, nous essaierons de formuler une manière de concevoir la responsabilité politique. Grâce à ces deux éléments, la responsabilité individuelle et la responsabilité politique, nous pourrons parvenir à formuler une conception de la méta-responsabilité comme forme de penser l'agentivité traversée par la mondialisation. ABSTRACT: In its historical deployment, socialist thought has attracted the attention of numerous experts and thinkers. The results reached from the above mentioned efforts, are quite irregular in fact. These studies are very often linked the marxist tradition, that shifted its identity to label previous social reformers as "utopian socialists". Specifically, our academic Spanish tradition has traditionally been dependant -historically and intellectually- on other Continental currents of thought. We state, that the preeminence and fundamental influence on our Spanish culture in (...) the Iberian Peninsula, has traditionally had its origin here, between modernity and industrialism, in France. Consistently, contributions concerning authors like Saint-Simon, Fourier or Cabet do exist. However, it is necessary to say that there is a bibliographical and very significant emptiness around one of the most relevant figures of European history in the 19th Century. Such emptiness has to do with the absence of publications concerning Robert Owen and his meaning in Spanish. En este artículo se emplea la epistemología del testimonio kantiana para analizar el concepto de _akrasia _epistémica (es decir, creer que p cuando se tienen motivos de orden epistémico para sostener que ¬p) en el caso de las teorías conspirativas. Se señala que las personas suelen mantener esa clase de discursos por motivos sociales (e.g. Pertenecer a un grupo que comparte esas ideas) antes que por una genuina incomprensión de la evidencia como tal, de modo que el problema es fundamentalmente (...) moral. Ante esto, se indica que la akrasia epistémica es primeramente una forma de akrasia moral que explica a través del autoengaño, en tanto que ningún agente moral quiere tenerse a sí mismo como malo. Por consiguiente, se puede afirmar que, desde el punto de vista de la audiencia, el sostener un testimonio que contenga teorías conspirativas en un asunto ético en principio, aunque con consecuencias epistémicas evidentes. _Palabras clave: akrasia epistémica, testimonio, teorías conspirativas, epistemología kantiana, autoengaño. En este artículo se argumenta que el procedimentalismo epistémico de Estlund, en tanto que modelo democrático, requiere de disposiciones éticas mínimas que no son explicitadas en la propuesta. Para mostrar este punto, aborda la propuesta de Estlund desde la noción de modelo democrático de Macpherson. Con esto, se advierte que las disposiciones éticas mínimas que configurarían una base ética implícita en el procedimentalismo epistémico serían tres: una disposición frente al conocimiento que involucra el proceso; otra frente al procedimiento democrático mismo; (...) y, finalmente, una frente al reconocimiento de la legitimidad de los resultados. In dieser Arbeit werden die Hauptbegriffe der Strukturalen Anthropologie von Lévi-Strauss analysiert: Struktur, Zeichen, Symbol und Mythos. Es wird die Frage aufgeworfen, ob ein vereintes Objekt der Anthropologie jenseits der verschiedenen Perspektiven der Sozialwissenschaften möglich ist. Die Trennung zwischen Ethnologie und Geschichte wird uns für die Fragestellung über ein allgemeines “menschliches Wesen” dienen. Dem Gegensatz zwischen Natur und Kultur gemäβ werden wir nach der positiven Rolle von Symbolen und Mythen als Gelenk zwischen diesen Extremen forschen. Letztlich werden wir die Grenze (...) der vermuteten Kontinuität zwischen Natur und Kultur durch die Rolle der Schrift erklären. Dazu dienen uns neben dem Werk von Lévi-Strauss auch die Werke der Autoren Cassirer, Rousseau, Eugeunio Trías, Gustavo Bueno und Derrida. (shrink)

In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

Ignorance is often a perfectly good excuse. There are interesting debates about whether non-culpable factual ignorance and mistake subvert obligation, but little disagreement about whether non-culpable factual ignorance and mistake exculpate. What about agents who have all the relevant facts in view but fail to meet their obligations because they do not have the right moral beliefs? If their ignorance of their obligations derives from mistaken moral beliefs or from ignorance of the moral significance of the facts they have in (...) view, should they be excused for failing to meet their moral obligations? It is not obvious that they should. In this paper we argue that the best non-skeptical accounts of moral responsibility acknowledge that factual ignorance and mistake will diminish moral responsibility in a way that moral ignorance and mistake will not. That is because factual ignorance is often non-culpable so long as it meets certain merely procedural epistemic standards but the same is not true of moral ignorance. Our argument is that the assumption that it is gets the standards of culpability for moral ignorance wrong, and that the mistake is encouraged by the thought that culpability in general requires an instance of known wrongdoing: that acting wrongly requires de dicto unresponsiveness to one’s obligations at some stage. We deny this and conclude that, therefore, ignorance and mistaken belief are indeed often perfectly good excuses – but far less often than some philosophers claim. (shrink)

In Meditations on First Philosophy, René Descartes argues that one cannot trust one’s senses since they are not a reliable source of obtaining knowledge of the world. One of Descartes’s main contentions to support such an argument is from his explanation of dreams, where one can feel one is awake but instead one is dreaming. Native Americans, however, may argue that the experiences one has in dreams are real and are a source of knowledge of the real world. Although Descartes (...) uses dreams to support his argument, some Native Americans have a different take on dreams. Dreams for Native Americans are a source of knowledge as well as a source for obtaining one’s identity. Gregory Cajete, in American Indian Thought, notes that “Dreams and Visions are a natural means for accessing knowledge and establishing relationship to the world. They are encouraged and facilitated.” In other words, it is through dreams that individuals are guided, destined, and informed. Therefore, dreams as understood by some Native Americans are an extension of reality that anticipate events that will happen or can happen. The focus of this paper is an exploration of the philosophical and religious epistemology pertaining to Native Americans as described in their accounts of dreams. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

Given the importance of the principle of causality for the demonstration of God’s existence, this paper attempts to justify the evidence and necessity of the principle of causality, by following Fr. Fabro’s Thomistic defense—based on the notion of participation—but adding a particular emphasis on the notion of “being which is not per se,” this latter as an explanatory notion of the notion of “being which is by participation.” The introductory remarks touch upon two misunderstandings regarding the notion of participation employed (...) as a subject of the principle of causality: the first, considering “participated being” as a synonym of “received being,” and the second, the confusion, regarding the notion of being by participation, between its notional dependence on the notion of being as a whole and its real dependence on the real intensive Being. Then, in the first point, the defense of the principle of causality is distinguished from other related problems, like the particular applications of this principle. In the second and main point, we try to justify the necessity of being caused in the being which is experienced as being by participation, as follows: 1) that which is something by participation is not this something per se; 2) now, that which is not per se, either is not or is per aliud, 3) Therefore, that which is something by participation is per aliud. In the third and last point, we endeavor to justify the Thomism of our defense and of our emphasis on this notion of “being which is not per se” by considering two texts of St. Thomas. (shrink)

These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). The value of testimony as a source of knowledge has been a subject of epistemological debates. The "trust theory of testimony" suggests that human testimony is based on an affective relationship supported by social norms. However, the advent of generative artificial intelligence challenges our understanding of genuine testimony. The concept of "quasi-testimony" seeks to characterize utterances produced by non-human entities that mimic testimony but lack certain fundamental attributes. This article analyzes these issues in depth, exploring philosophical perspectives on testimony and (...) the implications of conversational AI technologies on our epistemic practices. (shrink)

In this paper I defend the idea that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize that notion it is necessary to formulate an account of explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. Using the framework for belief revision developed by Isaac Levi, I analyze the conditions that information must fulfill to be both potentially explanatory and epistemically valuable (...) to an inquiring agent and to a scientific community. To be potentially explanatory, the information must state the relations of probabilistic relevance that the explanans bares to the explanandum. But a potential explanation con only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate the epistemic value of a potential explanation as a function of its credibility and its informational content. (shrink)

Unlike other classical arguments for the existence of God, Pascal’s Wager provides a pragmatic rationale for theistic belief. Its most popular version says that it is rationally mandatory to choose a way of life that seeks to cultivate belief in God because this is the option of maximum expected utility. Despite its initial attractiveness, this long-standing argument has been subject to various criticisms by many philosophers. What is less discussed, however, is the rationality of this choice in situations where the (...) decision-makers are confronted with greater uncertainty. In this paper, I examine the imprecise version of Pascal’s Wager: those scenarios where an agent’s credence that God exists is imprecise or vague rather than precise. After introducing some technical background on imprecise probabilities, I apply five different principles for decision-making to two cases of state uncertainty. In the final part of the paper, I argue that it is not rationally permitted to include zero as the lower probability of God’s existence. Although the conditions for what makes an act uniquely optimal vary significantly across those principles, I also show how the option of wagering for God can defeat any mixed strategy under two distinct interpretations of salvation. In the natural and social sciences, it is common to use toy models—extremely simple and highly idealized representations—to understand complex phenomena. Some of the simple surrogate models used to understand opaque machine learning (ML) models, such as rule lists and sparse decision trees, bear some resemblance to scientific toy models. They allow non-experts to understand how an opaque ML model works globally via a much simpler model that highlights the most relevant features of the input space and their effect on (...) the output. The obvious difference is that the common target of a toy and a full-scale model in the sciences is some phenomenon in the world, while the target of a surrogate model is another model. This essential difference makes toy surrogate models (TSMs) a new object of study for theories of understanding, one that is not easily accommodated under current analyses. This paper provides an account of what it means to understand an opaque ML model globally with the aid of such simple models. (shrink)

In this paper, I examine Pascal's Wager as a decision problem where the uncertainty is massive, that is, as a decision under ignorance. I first present several reasons to support this interpretation. Then, I argue that wagering for God is the optimal act in a broad range of cases, according to two well-known criteria for decision-making: the Minimax Regret rule and the Hurwicz criterion. Given a Pascalian standard matrix, I also show that a tie between wagering for God and wagering (...) against God is only possible under very narrow conditions when applying the Hurwicz criterion. Finally, I discuss three objections to these two versions of the Wager. The most pressing challenge comes from the Many-Gods objection. I conclude that this objection is even more challenging whenever one faces a situation of massive uncertainty about God's existence. I argue that addressing it requires a more detailed examination of the benefits of adopting a religious life compared to those of choosing non-theism, or an additional criterion that can break the tie between these options. There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Uno de los principios éticos mencionados más frecuentemente en los lineamientos para el desarrollo de la inteligencia artificial (IA) es la transparencia algorítmica. Sin embargo, no existe una definición estándar de qué es un algoritmo transparente ni tampoco es evidente por qué la opacidad algorítmica representa un reto para el desarrollo ético de la IA. También se afirma a menudo que la transparencia algorítmica fomenta la confianza en la IA, pero esta aseveración es más una suposición a priori que una (...) tesis basada en evidencia empírica. Tampoco se discute mucho hasta qué punto es técnicamente posible volver transparente la caja negra de la IA a través de los métodos de explicabilidad. En este capítulo haré un análisis de la interrelación entre los conceptos de transparencia, explicabilidad y confianza. Inicialmente, analizaré los diferentes tipos de opacidad algorítmica para entender mejor cuál es el problema al que nos enfrentamos. En las secciones subsiguientes trazaré la relación entre explicabilidad y transparencia, y presentaré los límites de los métodos actuales de explicabilidad. En la sección final, examinaré la evidencia empírica acerca de la relación entre transparencia y confianza en las decisiones automatizadas basadas en sistemas de IA. (shrink)

En este trabajo pretendo señalar en qué consiste el debate entre reduccionismo y antireduccionismo respecto de la justificación testimonial en la epistemología del testimonio. Para esto, se procederá de la siguiente manera: se expondrá las consideraciones epistemológicas de Hume y Reid sobre el testimonio para dar cuenta del reduccionismo y el antireducionismo en filosofía de la modernidad-temprana; por otra parte, se expondrá cómo se ha desarrollado dicho debate en la epistemología contemporánea. Sostenemos la tesis de que el concepto de hegemonía que desarrolló Gramsci es deficiente en dos puntos claves: en dar cuenta de los modos de integración característicos de las sociedades complejas, y en su proyección respecto a la construcción de la sociedad futura. Los dos aspectos están relacionados en cuanto que uno y otro remiten a la concepción de una totalidad ética, vertebrada por una concepción del mundo. Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. : New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible. St. Thomas Aquinas has always considered intelligence a potency higher than the will, absolutely speaking. That being said, and in my view, the existential primacy of the will in the act of freedom (particularly in choosing the existential end) is also indisputably Thomistic, as Cornelio Fabro has shown. This paper endeavors to explain Aquinas' doctrine on the absolute primacy of the intellect and thus show that these two primacies can be affirmed coherently, that is, the intellect’s absolute primacy and the (...) will’s existential primacy. Firstly, I will explain the reasoning St. Thomas Aquinas uses in the Summa to justify the absolute primacy of the intellect over the will. Secondly, I will explore some parallel texts, in order to shed light on my interpretation of the Summa and expand our view regarding this and related doctrinal points. Thirdly, I will offer a brief study of Fabro’s position, one in which his concerns regarding the intellect’s absolute primacy are taken into account and carefully considered. (shrink)

In a recent paper, Erasmus et al. (2021) defend the idea that the ambiguity of the term “explanation” in explainable AI (XAI) can be solved by adopting any of four different extant accounts of explanation in the philosophy of science: the Deductive Nomological, Inductive Statistical, Causal Mechanical, and New Mechanist models. In this chapter, I show that the authors’ claim that these accounts can be applied to deep neural networks as they would to any natural phenomenon is mistaken. I also (...) provide a more general argument as to why the notion of explainability as it is currently used in the XAI literature bears little resemblance to the traditional concept of scientific explanation. It would be more fruitful to use the label “understandable AI” to avoid the confusion that surrounds the goal and purposes of XAI. In the second half of the chapter, I argue for a pragmatic conception of understanding that is better suited to play the central role attributed to explanation in XAI. Following De Regt (2017) and Kuorikoski and Ylikoski (2015), the conditions of satisfaction for understanding an ML system are fleshed out in terms of an agent’s success in using the system. A number of recent writers have expressed scepticism about the viability of a specifically moral concept of obligation, and some of the considerations offered have been interesting and persuasive. This is a scepticism that has its roots in Nietzsche, even if he is mentioned only rather rarely in the debate. More proximately, the scepticism in question receives seminal expression in Elizabeth Anscombe's 1958 essay, ‘Modern Moral Philosophy’, a piece that is often paid lip-service to, but—like Nietzsche's work—has only rarely been (...) taken seriously by those wishing to defend the conception of obligation under attack. This is regrettable. Anscombe's essay is powerful and direct, and it makes a forthright case for the claim that, in the absence of a divine law conception of ethics, any specifically moral concept of obligation must be redundant, and that the best that can be hoped for in a secular age is some sort of neo-Aristotelianism. Anscombe is right about this, we think. And, among those who disagree, one of the very few to have taken her on at all explicitly is Christine Korsgaard, whose Kantianism of course commits her to the view that the concept of moral obligation is central, with or without God. Here, we try to show that Korsgaard loses the argument. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. Durante los últimos años, el problema de cómo justificar aquellas creencias que se originan en testimonios ha ocupado un lugar central en la epistemología. Sin embargo, muy pocas de esas reflexiones son conocidas en el derecho probatorio. En el presente ensayo analizo la prueba testimonial a la luz de estas reflexiones con el fin de poner de manifiesto los supuestos epistemológicos de algunos principios procesales. En concreto, analizo la legislación colombiana y la estadounidense en el marco de la disputa entre (...) el reduccionismo y el antirreduccionismo en la filosofía del testimonio. Al final sugiero una nueva aproximación epistemológica que replantea los términos de la disputa y que tiene implicaciones importantes para la valoración de la prueba testimonial en los procesos judiciales. El testimonio es nuestra mayor fuente de creencias. La gran mayoría de nuestras creencias han sido adquiridas a partir de las palabras de otros y no a través de la observación directa del mundo. Una de las peculiaridades de la mayor parte de las creencias testimoniales es que son aceptadas sin ninguna deliberación consciente. Mientras el testimonio sea consistente con nuestras creencias y la fuente sea confiable, la reacción más corriente es la aceptación automática de la información (Thagard 2004, 2005). (...) Nuestra confianza en el testimonio de los demás es un requisito no sólo para la construcción colectiva del conocimiento (Hardwig 1985, 1991), sino también para la interacción social en general. Sin embargo existen contextos en los que la aceptación apresurada de un testimonio falso puede tener consecuencias nefastas. En contextos científicos, legales, políticos y financieros, entre otros, se toman decisiones importantes y se implementan políticas cruciales a partir de las afirmaciones de otros. En estos contextos la aceptación de un testimonio debe ser el resultado de un proceso de decisión basado en criterios objetivos de justificación. Sin embargo, existen dos objeciones al intento de justificar la aceptación de un testimonio (Coady 1973, 1992). La primera es que cualquier justificación será irremediablemente circular puesto que la inmensa mayoría de testimonios obtienen su justificación, al menos en parte, de evidencia de tipo testimonial. La segunda es que nuestras inferencias acerca de la confiabilidad de ciertos tipos de testimonio nunca tendrán un apoyo inductivo lo suficientemente fuerte debido a que los casos en los que un tipo de testimonio puede ser verificado directamente en la experiencia nunca serán lo suficientemente numerosos. En este ensayo presento una solución al problema de cómo decidir racionalmente si un testimonio puede ser aceptado como evidencia probatoria en una investigación. Mi propuesta, que está basada en la teoría de revisión de creencias desarrollada por Levi (1984, 1991), muestra que la aceptación justificada de un testimonio está basada en exactamente los mismos mecanismos de adquisición de creencias que operan en el caso de evidencias no testimoniales; al mismo tiempo, la propuesta da cuenta de las particularidades que se presentan en el proceso de evaluación de una evidencia testimonial. Mi tesis es que la decisión de aceptar un testimonio es un proceso que se cumple en dos etapas. En la primera se busca una justificación pare el testimonio buscando todos los hechos que aumenten la probabilidad de que el testimonio sea verdadero, es decir, de que el testigo o declarante esté reportando verídicamente un hecho. La aceptación de estos hechos y de su relación probabilística positiva con respecto al testimonio está basada en la búsqueda de un equilibrio entre su credibilidad y su valor informativo. En la segunda etapa, se determina si la justificación obtenida en la primera es suficiente para la aceptación del testimonio, de nuevo buscando encontrar un equilibrio entre su credibilidad y la utilidad de la información que contiene en promover los intereses y metas cognitivas del investigador. Abstract In The Descent of Man (1879), Charles Darwin proposed a speculative evolutionary explanation of extended benevolence—a human sympathetic capacity that extends to all nations, races, and even to all sentient beings. This essay draws on twenty-first century social science to show that Darwin’s explanation is correct in its broad outlines. Extended benevolence is manifested in institutions such as legal human rights and democracy, in behaviors such as social movements for human rights and the protection of nonhuman animals, and in (...) normative attitudes such as emancipative values and a commitment to promote the rights or welfare of animals. These phenomena can be substantially explained by cultural evolutionary forces that trace back to three components of what Darwin called the human “moral sense”: (1) sympathy, (2) our disposition to follow community rules or norms, and (3) our capacity to make normative judgments. Extended benevolence likely emerged with “workarounds,” including political ideologies, that established an inclusive sympathetic concern for sentient life. It likely became as widespread as it is now due to recently arisen socio-economic conditions that have created more opportunities for people to have contact with and take the perspective of a broader cross-section of humanity, as well as other species. ABSTRACT: In this text, we are going to try to introduce a few brief notes - without excessive pretensions -, concerning those things that, from a historical and also from an intellectual and point of view, surround the figures of Robert Owen, Fourier or Saint Simon. Certainly, intellectually, our sources do not let us notice a very specific influence on the "utopian socialists" of the 19th Century. It will be very difficult to find historical evidence. However, what we can do (...) is to assume the French Revolution of 1789 as a turning point for the radical traditions, both British and Continental, to introduce Romanticism as the real source from which the utopian nineteenth-century thought was derived from. Then, Romanticism is where we will be able to read something about Robert Owen. Likewise, we will approach a very succinct reading of paleo-socialism, focusing on the context of the British Islands where the Industrial Revolution took place to become another great event in the lifetime of the "utopian socialists".
